On 24 May 2019, he was sworn in as a judge of the Supreme Court.

Chief Justice of India Sanjeev Khanna has officially recommended the name of Justice BR Gawai as his successor. His name has been sent to the Union Law Ministry for approval. With this, Justice Bhushan Ramakrishna Gavai has been scheduled to become the 52nd Chief Justice of India.

The tradition is that the current CJI recommends the name of his successor only when he is urged to do so. The term of the current CJI Sanjeev Khanna ends on 13 May.

Justice Gavai is named in the seniority list after CJI Khanna. Therefore, Justice Khanna has taken his name forward. However, his term will be only 7 months.

According to a profile on the Supreme Court website, Justice Gavai was promoted as Supreme Court judges on 24 May 2019. His retirement date is 23 November 2025.
