In Mau’s MP/MLA court, Abbas Ansari has been sentenced to two years in a Hate speech case related to 2022.
Mafia Mukhtar Ansari’s MLA son Abbas Ansari has been sentenced to 2 years in the Hate Speech case. The Mau court gave this verdict on Saturday. Along with the announcement of the sentence, Abbas’s legislature will also go away. The court sentenced Abbas to 6 months along with Abbas to his election agent Mansoor. Both were also fined 2-2 thousand.
The court convicted both of them at 11:30 am today, while Abbas’s younger brother Umar Ansari was acquitted. MLA’s lawyer Daroga Singh said- After being sentenced, Abbas and Mansoor filled bail bonds of 20-20 thousand, after which both got bail.
After getting bail, when Abbas left the car for home, the policeman tried to stop him. Said- Wait for half an hour. On this, Abbas said- I am hungry since morning, I will come after eating food. The policeman replied- Do not cross the border of the district. Abbas turned back and replied- we are trapped ourselves, now what else will we work to get trapped?
The case in which Abbas has been sentenced is of the assembly elections held in 2022. During this, Abbas said in an election rally- I have come to tell SP chief Akhilesh Yadav, no one will be transferred for 6 months after the formation of the government. Wherever it is, it will remain there. First there will be an account. Then there will be transfer.

After the announcement of the sentence, Abbas Ansari started leaving the court, then the policeman stopped him. Said- Do not cross the border of the district.
The court premises were converted into a cantonment after the announcement of the sentence. SOG personnel were also deployed along with the police. Before appearing in court, a supporter from Abbas tried to forcibly enter the court, which was taken into custody by the police.
Abbas OP is an MLA from Rajbhar’s party Subhaspa. He reached court at 8 am on Saturday morning with his younger brother Omar Ansari and supporters. He shook hands and also greeted the supporters.

Under the order of the Supreme Court, if any MP-MLA is sentenced to 2 or more than 2 years, his membership itself ends. On receiving a copy of the court order, the Legislative Secretariat announces the vacancy to the respective seat. After this, its information is sent to the Chief Electoral Officer. A proposal is sent to the Election Commission of India to hold a by-election through the Chief Electoral Officer.
Know what way to Abbas to save the legislative
Law experts say that the High Court can go against the sentence. He has been punished maximum in this case. They can appeal to cancel or reduce the sentence. If the High Court stops the punishment, the membership may remain at the moment.
However, this action should be taken before the seat is declared vacant. The case is related to Abbas Ansari. Therefore, a copy of the court order will reach the assembly on Monday. The Assembly Secretariat will announce the vacancy to the seat by Monday or Tuesday.
If there is no relief from the High Court, you can knock the door of the Supreme Court. If there is no relief from there, then the legislature is sure to go.

Abbas lawyer said- will go to session court against sentence
Abbas’s lawyer Daroga Singh said- In 2022, a case was filed under Section-171 H and 506-B in this case only. But the police increased the sections of 186, 189 and 153-A in it. The testimony of the whole case was also done by the police only. The court has convicted Abbas and Mansoor. Abbas has been sentenced to 2 years and Mansoor has been sentenced to 6 months. There is a rule of going to legislature on the sentence of 2 years, but it is not the last court. We will go to the session court and take a stay there.

On April 4, 2022, an FIR was lodged in the city Kotwali on the complaint of the then SI Gangaram Bind. Apart from Abbas, his younger brother Umar Ansari and election agent Mansoor, 150 unknown people were accused.
These were imposed on the IPC sections- 506 (threatened), 171F (interrupted election process), 186 (obstructing public servant), 189 (threatening public servant), 153A (communal disharmony) and 120B (conspiracy).

Abbas was released from jail after 2 years and 8 months on March 21 Abbas Ansari was released from jail after 2 years 8 months on March 21 in the Money Laundering and Gangster Act case. Abbas was released after 15 days after the court order, after which Abbas was released.
Abbas was detained by the Enforcement Directorate (ED) in November 2022. He was accused that he was part of the criminal network and collected money illegally. The ED had registered a case against him under the Money Laundering and Gangster Act after investigation.

Wife Nikhat was jailed after meeting Abbas without permission On February 11, 2023, Nikhat Ansari came to meet Abbas Ansari in Chitrakoot Jail without permission. She was meeting her husband Abbas in the jailer’s room, when the SP and DM suddenly reached. However, Abbas was expelled from the room by jail workers shortly before the raid.
After the matter came to light, Abbas Ansari was transferred from Chitrakoot District Jail to Kasganj Jail. However, Nikhat was kept in Chitrakoot Jail. Nikhat was released after being in jail for about 154 days.

- Kuldeep Sengar: Kuldeep Singh Sengar, MLA from Bangarmau, was sentenced to life imprisonment in a mass rape case from a minor in Unnao. His assembly membership was over after the sentence was sentenced. An order was issued by the Principal Secretary of the Legislative Assembly to abolish his membership from 20 December 2019.
Membership goes under this rule Under Section 8 (3) of the Representation of the People’s Act 1951, if an MP or MLA is convicted in a crime and is sentenced to 2 years or more, his Parliament or Assembly membership will be over. He will not be able to contest elections until 6 years after release.
Section 8 (4) of the ‘Representation of the Peoples Act’ says that the membership of the convicted MP or MLA does not end immediately. He has three months time. During this time, if he appeals to the High Court or Supreme Court, then the membership does not go until the hearing of that appeal is completed. If he does not appeal, his membership is terminated after three months.
However, in July 2013, the Supreme Court described the exemption under Section 8 (4) of the ‘Representation of the People’s Act 1951’ in the Lily Thomas vs Union of India case. The Supreme Court said that if MPs or MLAs are convicted and sentenced to 2 years or more, their Parliament or Assembly membership will be over as soon as they are convicted.
