Recently, in a divorce case, the Madhya Pradesh High Court ruled that the wife’s private WhatsApp chat can be presented as evidence under Section 14 of the Family Court Act, 1984, even if it is obtained without her permission. In this case, the husband accessed his private WhatsApp chat by installing a special app (possibly a detective app) on his wife’s phone and found that he was in a extramarital affair. The husband’s lawyers decided to present it as evidence in the court and demand a divorce on the basis of cruelty and adultery.

The wife’s lawyers challenged the move and opposed the presenting of her WhatsApp chat in the court, arguing that this action of the husband violates her right to privacy under Article 21 of the Indian Constitution and Section 43, 66 and 72 of the Information Technology Act. The Madhya Pradesh High Court rejected this argument and said that even though the right to privacy is recognized as a fundamental right, it is not complete and it has exceptions and limits.
