There has been a poor relationship between the Governor and the Stalin government since assuming power in 2021.
The MK Stalin government of Tamil Nadu got a big relief from the Supreme Court on Tuesday. The Supreme Court has termed the government’s 10 essential bills being stopped by the Governor as illegal. The court said that this is an arbitrary step and is not correct from the perspective of law. The Governor should have given help and advice to the state assembly.
The Supreme Court said-

The governor should be like a friend, philosopher and a way shown. You take oath of constitution. You should not operate on behalf of any political party. You should become a catalyst, not inhibitors. The governor should keep in mind that there is no obstacle.
The Supreme Court had a hearing on the petition filed by the Tamil Nadu government. It was said that Governor RN Ravi has stopped the necessary bills of the state. Explain that former IPS officer RN Ravi, who has worked in the Central Bureau of Investigation (CBI), took over as the Governor of Tamil Nadu in 2021.

1. The bench of Justice JB Pardiwala and Justice R. Mahadevan said that it is illegal and arbitrary to send these 10 Bills to the President by the Governor. This action is canceled. All the action of the Governor is invalid.
2. The bench said that Governor Ravi did not work with his heart. These bills will be considered approved from the same day when the assembly passed the bills and sent it to the Governor again.

2. The court said that the Governor should stop the bill or send it to the President, they will have to do this work within a month with the advice of the Council of Ministers. If the assembly re -passes the bill, then the Governor will have to approve within a month.
The court made it clear that it was not weakening the powers of the Governor, but all the action of the Governor should be according to the principles of parliamentary democracy.
Governor’s rights on bill Article 200 of the Constitution says that when a bill is sent to the Governor, the Governor has 4 options.
1. Can approve
2. Can stop approval
3. Can send to the president
4. Can send the assembly for reconsideration
If the assembly passes the bill again, then the governor cannot stop the approval. However, if the Governor feels that the bill is linked to the Director Principles or National Importance of the Constitution, State Policy, he can send it to the President.
Stalin said- all state governments won CM MK Stalin described the Supreme Court’s decision as historic. He said-

This is not just Tamil Nadu, but the victory of the state governments of the entire country. Now these bills will be considered as the approval of the Governor.
Stalin said in the assembly on Tuesday- several Bills passed in the assembly were returned by the governor. These were passed and sent to the Governor, but he neither approved nor explained any reason. According to the Constitution, when a bill is passed again, the governor has to approve it. But he deliberately delayed.
Bills were passed by Tamil Nadu government in special session Governor RN Ravi had returned 10 out of 12 bills passed by the Tamil Nadu government on 13 November 2023 to the Assembly without giving reasons and sent 2 bills to the President. After this, these 10 bills were re -passed in the special session of the Tamil Nadu Legislative Assembly on 18 November and the Governor Secretariat was sent to the Governor’s approval.
The dispute over not signing the bill was also accessible to the Supreme Court in November 2023. In the petition filed in the Supreme Court, the state government demanded that the Governor should agree on all these bills as soon as possible. The petition states that this attitude of the Governor is illegal and hanging these bills leads to defeat of Democracy. On this, the Supreme Court had said in the hearing- To resolve the issue, the governor should sit together and discuss the CM.

There has been a poor relationship between the Governor and the Stalin government since assuming power in 2021. The Governor has said that the Constitution gives him the right to stop their consent on any law. The dispute between the Raj Bhavan and the state government has also reached the Supreme Court and Rashtrapati Bhavan.
