The Supreme Court on Thursday directed the government to set up a POCSO court on a highest priority basis to deal with cases of sexual offenses against children.
The court said that many states have set up special POCSO courts, but in states like Tamil Nadu, Bihar, Uttar Pradesh, West Bengal, Orissa, Maharashtra, more courts need to be made due to case pendency.
A bench of Justice Bella M Trivedi and Justice PB Varle said that the deadline is not being followed to investigate the case due to the special courts for the protection of children from sexual offenses (POCSO) Act.
The court has also directed to file a charge sheet within the stipulated period besides completing the trial inside the deadline prescribed for the Poxo case.
Court sought information about pending case
The Supreme Court had directed Senior Advocate and Amicus Curie V Giri and Senior Advocate Uttara Babbar to give state -wise details on the position of POCSO court. The Supreme Court was hearing a petition in which he took action by highlighting “dangerous increase in the number of child rape incidents”.
The court asked the state governments to set up two courts in the districts where the number of pending cases of child abuse under the POCSO Act is more than 300. The court said that under the POCSO Act, the direction of July 2019 to construct a court in every district with more than 100 FIR meant that the Designed Court would only deal with such cases under the law.
Surprising figures related to POCSO cases
- In 2022, 38,444 victims were recorded under sections 4 and 6 (severe sexual harassment) of the PocSO Act, out of which 38,030 were girls and 414 boys.
- By October 2023, more than 3000 cases were registered under the POCSO Act in Karnataka, with more than 200 cases on an average every month.
- From January 2023 to December 2023, POCSO had 9,108 cases pending in Delhi. If new cases are left, these matters may take 27 years to settle.
