Permission has to be obtained from the court to eliminate 20 weeks of pregnancy.
The Bombay High Court on Tuesday allowed the 14 -year -old rape victim to abort. The victim is 24 weeks pregnant. The court said- If a minor girl wants, she can have an abortion.
This case is from Raigad district of Maharashtra. Here a young man befriended a minor on Instagram, then sexually abused him.
The victim’s mother was suspicious when the daughter’s period did not come for six months. Pregnancy was confirmed after examination in the hospital. An FIR has been registered against the accused youth under the POCSO Act.
After friendship on Instagram, the young man sexually abused the minor.
Court allowed after medical examination
On 6 June, the High Court directed the surgeon of Alibag Civil Hospital in Raigad to constitute a medical board. The board said after investigation that the victim is anemia (anemia) and first hemoglobin levels have to be cured. When the hearing was held again on Tuesday, the board told the court that now the girl is fit for surgery. Also, there will be no effect on his fertility in future.

Delhi High Court: 27 -week pregnant woman did not allow abortion
On 7 May 2024, the Delhi High Court dismissed the petition seeking abortion of a 20 -year -old woman. The woman sought permission for abortion in 27 -week pregnancy. However, the court said that the medical report found the fetus absolutely healthy. There is no danger to the mother and the child in continuing pregnancy. Supreme Court: 32 -week fetal abortion allowed
Earlier, the Supreme Court had allowed the most week of pregnancy abortion permission in 2017. The Supreme Court had allowed an abortion of a 32 -week rape victim in Mumbai. This minor was raped by an acquaintance of his father. Apart from this, in the year 2024, the Supreme Court also allowed a 14 -year -old girl to miscarriage in 30 weeks of pregnancy.
What does abortion law say
Under the Medical Termination of Pregnancy (MTP) Act, any married woman, rape victim, disabled woman and minor girl are allowed for up to 24 weeks. If the pregnancy is more than 24 weeks, then permission has to be obtained from the court on the advice of the Medical Board for abortion. The MTP Act was changed in the year 2020.
