The Delhi High Court upheld the dismissal of an Indian Army officer, which was removed from service in 2017 due to non -participation of a religious parade. The officer Samuel Kamleson refused to join the parade, saying he was from Christianity.
Kamalsen challenged the dismissal by filing a petition in the court. He appealed to reinstate the job with the demand for pension and gratuity.
But on May 30, a bench of Justice Naveen Chawla and Justice Shalinder Kaur upheld the army’s decision.
The court said;-
Our army is made up of people from all religions, castes and regions, whose sole purpose is to protect the country. The unity of the army is formed by their uniform, not religion or caste.
Kamalsan’s behavior against secular principles of the army Kamalsan was admitted to the post of Lieutenant in the 3rd Cavalry Regiment in March 2017. He was made the troupe leader of ‘B Squadron’, which included most of the Sikh jawans.
Kamalsen said in his petition that his regiment has a temple and gurudwara, but there was no ‘Sarva Dharma Sthal’ for all religions, nor was the church.
On this, the court said that even though the names or traditions of some regiments are related to any religion or region, it does not weaken the secular character of the army. The court also admitted that war announcements (war -fed) may seem religious in the army several times, but their aim is only to increase enthusiasm and unity.
The court said- it is indiscipline not to obey the order of the army The court also said that Kamalsen placed his religion above the legitimate order of his senior officer, which is considered indiscipline in the army.
“The level of discipline in the army is different from common citizens,” the court said.
Finally, the court said that Kamalsan was given counseling several times and his dismissal was decided keeping in mind the serious thinking and situation.
This decision reflects the strength of the secular and disciplined structure of the army.
