Bombay High Court canceled non-bailable warrant against Arjun Rampal

New Delhi: The Bombay High Court has given relief to Bollywood actor Arjun Rampal. The ongoing non-bailable warrant against the actor has been canceled. This warrant was issued in a 2019 tax evasion case. On 16 May, a bench of Justice Advaita Sethna said that the decision of the lower court was against the law and was taken without thinking. The court called it “mechanical and vague”.

In fact, this matter is related to Section 276C (2) of the Income Tax Act. This applies to those who do not deliberately pay taxes or penalty and interest. Arjun Rampal is accused of not paying tax. A warrant was issued against him in this case.

What was the matter

Rampal told the High Court that his lawyer had sought exemption from appearance in the magistrate court. But the magistrate rejected this application and issued a direct non-bailable warrant. The High Court said that the case is a maximum sentence of three years and it is a bailable offense. In such a situation, it was not right to remove non-bailable warrants.

The court also said that the magistrate did not write any concrete reason before taking out the warrant. In such a situation, this order cannot be called correct. Now the next hearing of this case will be held on 16 June.

Justice Advaita Sethna, who was hearing the case, agreed with Arjun Rampal’s arguments, saying that the lower court order was “mysterious” and biased. The High Court dismissed the non-bailable warrant, saying that the crime for which it was issued is bailable and there was no legal basis for such strict action.
