The Bombay High Court granted bail to a 22 -year -old youth who has been jailed for 3 years on charges of rape (POSCO Act) in a decision on Monday. The bench of Justice Milind Jadhav said that the 15 -year -old minor knew what she was doing, she also knew the results.
The bench said in its order- It is clear from the girl’s statement that the two had love affairs and physical relations were made by consent. The girl left her house on her own free will and went with the young man.
The court also notice that when the girl called the family and told that she was in a village in Uttar Pradesh, she did not take any action. The bench said that despite the provision of the law being tough, bail cannot be denied in the interest of justice, especially when the case has been pending for four years and the trial has not started yet.

On 8 August 2020, a 15 -year -old girl went missing from her home. The girl’s father suspected that she had run away with a young man. The father went to the young man’s rented house in Navi Mumbai and searched, but he was not found there. On contacting on the phone, the young man refused to know about the girl. Two days later, the girl told her father that she was in the village of a young man in Uttar Pradesh.
In May 2021, about 10 months later, the girl told her father that she was pregnant and the young man refuses to marry. He sought help in coming back to Navi Mumbai. The father went to Uttar Pradesh with the police and brought the girl back with another woman.

According to the girl, she knew the young man from 2019. The young man had told him his feelings, to which he also gave a positive answer. The two met regularly despite the parents’ prohibition. In March 2020, the young man forcibly made physical relations with her, but returned to her village due to Kovid lockdown. He later returned to take the girl with him.
