Additional Sessions Judge (ASJ) Dr. Hardeep Kaur, while hearing on Tuesday, said, “The court is not in favor of granting bail to the accused in view of the seriousness of the allegations and the nature of the crime. So this bail petition is rejected.”
The court said that the accused, describing himself as the nephew of the Union Home Minister, gave the pretense of getting a tender of Rs 90 crore from the complainant for renewal of Rashtrapati Bhavan and in return took Rs 3.9 crore through cash and RTGS from the complainant.

The government lawyer said that the complainant is still fully supporting the investigation and has confirmed the prosecution claims.
During the bail plea, the counsel for the accused argued that Nayyar has been in jail for 39 months, the investigation of the case has been completed and a charge sheet has also been filed. It was also told that other co-accused have already got bail.
To this, the court said, “Only spending long periods in jail and filing of charge sheet cannot be the basis of bail. The court also has to consider factors such as seriousness of the crime, the behavior of the accused, the possibility of repeating the crime, the risk of affecting or intimidating the witnesses, and the possibility of obstructing the justice process.”
The court also made it clear that the accused cannot demand bail on the same basis as other co-accused, as his role is different and more serious from them.

According to the prosecution, the case was registered on the complaint of complainant Gursimardeep Singh, who performs a leather business named ‘Jalandhar Leather India Private Limited’. In June 2020, his family friend Amit Talwar met his accused Ajay Nayyar at Jalandhar Gymkhana Club. At the same time, the accused described himself as the nephew of Home Minister Amit Shah and said that he can get him a tender of Rs 90 crore to supply leather for renewal of Rashtrapati Bhavan.
In this deception, the complainant gave a huge amount to the accused, after which an FIR was lodged against Nayyar and arrests were made. After the court’s decision, the accused will now have to stay in jail.
