The Madras High Court has allowed two women to live together like a family. The court said that even though a marriage is not the only way to create a family, gay couples can create a family.
The bench of Justice GR Swaminathan and Justice V Laxminarayanan was hearing the writ petition of a woman. The woman said that her partner was forcibly imprisoned by the family members and is not being allowed to meet her.
The court said- it seems that he was forcibly taken to his house and beaten. He told us that his family members forced them to perform some special rituals so that it would become ‘normal’. On 17 October 2023, the Supreme Court refused to give legal recognition to the Sem sex marriage.

In January 2025, 13 reconsideration petitions were dismissed. 13 reconsideration petitions were filed against the Supreme Court’s decision this year. The court dismissed these petitions. The court had said that there is no flaw in the records and the views expressed in the decision are according to the law and there is no interference in it.
On 17 October 2023, the Constitution Bench of 5 judges said that the court cannot change the Special Marriage Act. The court can only interpret the law and implement it. Former Chief Justice DY Chandrachud said that it is the job of Parliament to decide whether the provisions of the Special Marriage Act need to be changed.
